TERMS AND CONDITIONS

NOTIFICATION OF LIMITATIONS TO FOLLOW.  PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

These Terms and Conditions govern the relationship between you (the client) and EcoFirst, LLC. of Jackson, Wyoming doing business as EcoFirst Adventures (hereinafter referred to as “the Company” or “EcoFirst”). By booking a trip, you agree to be bound by these Terms and Conditions which outline, among other things, our cancellation policy and certain limitations of liability. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

1. THE CONTRACT
All persons wishing to make a booking have carefully read and understand the Terms and Conditions that follow. By making a booking by telephone, or on our website, or by mail or facsimile with the Company or its Agents, you accept and are bound by these Terms and Conditions. The person or persons named on the booking are hereafter referred to as the “Client”. All bookings are made with EcoFirst “the Company”, which sells the tours described in this brochure and on the Company website or through its “Agents” who sell the Company’s tours through an agreement with the Company. These Terms and Conditions shall constitute the entire agreement between the Company and the Client relating to the subject matter herein, and shall constitute a binding agreement. There is no verbal or written; representation, warranty, collateral agreement, prior agreement, description of services, or conditions, other than as expressed herein. The service to be provided is/are the tour(s) referred to in the booking confirmation.

2. RESERVATIONS/DEPOSITS
The client’s booking cannot be confirmed until a deposit is received in the Company’s office. A non-refundable deposit of $500 is payable at the time of booking. Payment in the form of personal check or money order and in US Dollars must accompany the Reservation and Information Form. Final payment is due 45 days prior to departure. EcoFirst will invoice customers for final payment. If a booking is made within 45 days of departure, payment in full must be made at the time of booking.

3. CHANGE FEES
The person who made the original booking must confirm any changes to the original booking in writing. A $100 administrative fee will be assessed as well as any charges levied by hotels or airlines. It may not be possible to honor change requests that are received within 30 days of the original departure date.

4. WHAT’S INCLUDED
Package prices typically include (unless otherwise stated on the itinerary):

  • All meals
  • Domestic airfare within the Philippines
  • Guide services and equipment
  • Land Transportation
  • Hotel and resort accommodations
  • Airport transfers
  • Travel medical insurance, including limited trip interruption insurance
  • Camping equipment for itineraries with camping nights

5. WHAT’S NOT INCLUDED
Package prices do not include:

  • International airfare to the Philippines
  • Tips and gratuities
  • Incidentals and personal items
  • Meals and drinks not listed
  • Travel cancellation insurance

6. BAGGAGE
Due to limited capacity on domestic aircraft segments, baggage may be limited to 2 items totaling 22 pounds (10 kilos). Excess baggage is charged at $1 per kilogram per flight segment. The Tour Leader will collect a charge if the luggage exceeds the established weight and/or dimensions, but the Company cannot guarantee that additional or oversized luggage will be transported. The client must be able to lift and comfortably transport their bag short distances when porters are not available. Porter service may not be available at all hotels, airports, ferry terminals, etc. nor may it be available in all destinations.

7. CANCELLATION BY THE COMPANY
The company reserves the right to cancel a tour for any reason, but will not cancel a tour less than 60 days prior to departure except for force majeure, unusual or unforeseen circumstances outside the company’s control. When the Company cancels a tour, the Client may choose between a full refund of all monies paid or any alternative tour offered by the company. The company is not responsible for any incidental expense that you may have incurred as a result of your booking such as visas, vaccinations, non-refundable international and/or connecting flights or loss of enjoyment, etc. If the alternative tour chosen by the Client is of a lower value than that originally booked then the Client is entitled to a refund of the price difference. If the alternative tour chosen by the Client is of a higher price than that originally chosen then the Client must pay the difference.

8. CHANGES TO ITINERARY
The Client appreciates and acknowledges that the nature of this type of travel requires considerable flexibility and should allow for alternatives. The itinerary provided for each tour is merely representative of the types of activities contemplated, and the Company is under no contractual obligation to strictly follow it. It is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate and other unpredictable or unforeseeable circumstances.

9. RESPONSIBLE BEHAVIOR
The client agrees to abide by the authority of the Company Tour Leader or the Company agents. If the personal health or conduct of a client is deemed to endanger the safety or enjoyment of the individual or group the Company Tour Leader may decide to exclude the client from part of the tour or completely remove the client from the tour. Any cause of danger, distress or annoyance to the group will be acted upon. Any expenses incurred from removal from a tour will be the responsibility of the client.

10. CLIENT INFORMATION
The client will be responsible for providing correct information regarding personal details (name, address, contact information) and international flight information (if applicable). The Company will not be responsible for incurred costs, which have occurred due to incorrect, incomplete or inaccurate information.

11. INSURANCE
It is mandatory that all Clients obtain travel medical insurance with a minimum coverage of US $100,000 while traveling with the Company and this insurance must cover personal injury, medical expenses, repatriation expenses, and evacuation expenses. Package prices will include travel insurance to include the above stated coverage, unless otherwise instructed by the client. If the client does not accept the included insurance coverage, he/she will be required to show proof of alternative and sufficient coverage.
It is strongly recommended that additional coverage be purchased to include cancellation, curtailment, loss of belongings and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client.

12. MEDICAL INFORMATION
It is vital that persons with medical problems make them known to us well before departure. The trip leader has the right to disqualify anyone at any time during the trip is he or she feels the trip member is physically or mentally incapable or if a trip member’s continued participation will jeopardize the individual involved or the group. Refunds are not given under such circumstances. Hospital facilities for serious problems are often unavailable and evacuation can be prolonged and difficult. EcoFirst assumes no responsibility regarding provision of medical care. Trip members will receive appropriate health information to be filled out and returned to us. By booking a trip, the client is confirming their physical ability to travel and to partake in the activities described. If you are age 65 or older, we may require clearance from your physician.

13. TRAVEL DOCUMENTS
The client must be in possession of a valid passport required for entry, departure and travel through each destination point along the itinerary of the tour (your passport must be valid 6 months past your return date), all visas, permits and certificates including your vaccination certificates, insurance policies, required for the whole of the journey. The Client accepts full responsibility for obtaining such documents and permits, and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by the Company regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy to the Client, and the Company is not responsible for any errors or omissions as to the information provided.

14. CANCELLATIONS/REFUNDS
Our refund policy applies to all cancellations, regardless of situation. The date of trip cancellation is the date on which EcoFirst receives the written cancellation. Cancellation charge is as follows:

  • Cancellation request received 45 days or more prior to departure – loss of deposit
  • Cancellation 44-30 days prior to departure – 75% of tour price
  • Cancellation less than 30 days prior to departure – 100% of tour price
  • No refunds if you voluntarily leave a trip for any reason after trip has begun.
  • No refunds for any accommodation, transport, guiding, meals, or services that are not utilized.

HEALTH INSURANCE
Every traveler with EcoFirst must be covered by personal medical insurance. All package prices include insurance. Insurance coverage can be waived upon proof of other sufficient coverage ($100,000 minimum).

RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS
All EcoFirst travelers will be required to sign this in the waiver:

The client (hereinafter "I') is aware that, during the trip I am choosing to participate in, under the arrangement of EcoFirst (hereinafter the Company) and its agents, I may be subjecting myself to certain risks including, but not limited to: forces of nature, travel in remote areas and wilderness terrain, and transportation by air, train, automobile or other conveyance. I, the client, am aware that rock climbing, sea kayaking, surfing, whitewater rafting, scuba diving, and other activities are inherently dangerous, and by undertaking these activities I assume a high degree of risk. I am also aware that medical services and facilities may not be readily available throughout the duration of the trip. I recognize that such risks may be present at any time during the trip. I am further aware that the Company acts only as the agent for the owners, contractors, and suppliers providing means of transportation and/or all other related travel services and activities and assumes no responsibility howsoever caused for injury, loss, or damage to person or property in connection with any service resulting directly or indirectly from: Acts of God, detention, annoyance, delays and expenses arising from quarantine, strike, theft, failure of any means of conveyance to arrive or depart as scheduled, civil disturbance, government restriction or regulation, discrepancies or change of transit or hotel services, over which it has no control. I understand that if any trip has to be delayed because of weather, road conditions, flight delays, sickness or other contingencies for which the Company cannot reasonably make provision, the cost of delays is not included in the trip fees. I am voluntarily participating in these activities with full knowledge of the dangers and risks involved and agree to assume all risks, including injury and death. In consideration of the right to participate in the trip, I have and so hereby fully assume all risks of the above hazards and hereby release and discharge the Company and its agents from all actions, claims or demands resulting from my willing participation in the trip. I am aware that this is a release of liability and a contract between me and the Company and that I have signed it of my own free will.

This release of liability and assumption of all risks agreement is entered into on behalf of all members of my family, including any minors accompanying me or who travel on an EcoFirst trip independent of me and for whom I certify that I am the parent or legal guardian. This agreement is also binding on my heirs, administrators, executors, legal representatives and assignees. All applications are subject to acceptance by EcoFirst.

I have carefully read this entire Release of Liability and Assumption of All Risks, and I have read the complete Terms and Conditions attached, including notification of cancellation penalties. I fully understand all.
